PCC deputizes NBI in dawn raid on flood control bidrigging probe

The Philippine Competition Commission (PCC) has deputized the National Bureau of Investigation (NBI) to conduct a dawn raid as part of PCC’s ongoing investigation into the alleged bidrigging in government flood control projects. The inspection was carried out pursuant to a court order authorizing PCC, its deputies, and agents to examine and secure information relevant to potential anticompetitive practices.

The operation covered premises in Bonifacio Global City, Taguig, associated with Sunwest, Inc./Eco Leisure and Hospitality Holding Company, Inc./Zaldy Co, where the PCC and NBI reasonably suspect that relevant documentary and electronic records related to the ongoing investigation were located.

This decisive action underscores PCC’s commitment to ensuring that businesses operate within the bounds of the Philippine Competition Act (PCA). The PCC’s conduct of dawn raids is in line with Supreme Court Administrative Matter No. 19-08-06-SC or the Rule on Administrative Search and Inspection that established the procedures for inspection orders under the PCA. Dawn raids are a globally recognized enforcement tool used to uncover possible cartel behavior and other anticompetitive conduct.

PCC assures the public that all procedures are undertaken with due regard to rights and safeguards under the law. The Commission underscores its cooperation with the broader efforts of government to ensure accountability of those involved in bid-rigging in flood control projects.
